These Terms of Use govern access to NovaKey Realty digital properties (the Services). They are written for clarity; they do not replace advice from counsel familiar with your transaction, jurisdiction, or entity structure.
1. Agreement and eligibility
By using the Services you agree to these Terms and to our Privacy Policy. If you are using the Services on behalf of a company or other entity, you represent that you have authority to bind that entity. If you do not agree, discontinue use.
2. Information only, not professional advice
Content on the Services is for general informational purposes. It is not legal, tax, accounting, insurance, securities, or investment advice. Decisions about buying, selling, leasing, or financing real estate should be made with professionals who know your facts and the applicable jurisdiction.
3. Brokerage relationship and licensing
NovaKey Realty offers real estate brokerage services only where it is licensed or otherwise lawfully authorized. A signed agreement may be required before NovaKey represents you as a buyer, seller, landlord, or tenant. Submitting a form, creating an account, or browsing listings does not by itself establish an agency or fiduciary relationship.
4. Listings, data, and marketplace reality
Listing details may come from sellers, MLS feeds, developers, or third parties. Pricing, incentives, availability, taxes, HOA terms, square footage, and condition descriptions can change without notice and may contain errors. Photographs and staging may not reflect current condition. You are responsible for verifying material facts, permits, boundaries, and any matter that matters to your decision.
- We may correct, remove, or annotate content when we become aware of inaccuracies that could mislead a reasonable user.
- Nothing on the Services guarantees that a property will appraise, finance on stated terms, or remain available through closing.
5. Compensation and separate services
How NovaKey is paid depends on the written arrangement for your mandate (for example buyer agency, seller listing, referral, or lease). Professional packages, advertising, syndication, or subscription products may be billed separately; those fees are disclosed when you purchase them.
6. Acceptable use
You agree not to misuse the Services. Among other things, you will not: violate law; attempt unauthorized access; probe or stress our systems without permission; scrape or harvest data in bulk in violation of these Terms or applicable law; send spam; impersonate others; or upload malware. We may suspend access when we reasonably believe a violation occurred.
7. Accounts, credentials, and communications
You are responsible for activity under your account. Keep passwords secure. We may send operational and transactional messages (security alerts, confirmations, appointment changes) by email or SMS as applicable. Marketing messages are handled as described in our Privacy Policy where the law allows opt-out.
8. Intellectual property
The Services, including branding, layout, editorial copy, compilations, and software, are owned by NovaKey Realty or its licensors. Limited personal, non-commercial browsing is allowed. You may not copy, mirror, modify, or create derivative works except as expressly permitted or as required for normal browser caching.
9. Third-party sites and tools
The Services may link to maps, lenders, inspectors, payment processors, or other tools. Those experiences are governed by their own terms and privacy policies. We are not responsible for third-party content, availability, or security.
10. Disclaimers
To the fullest extent permitted by law, the Services are provided as is and as available, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
11. Limitation of liability
To the fullest extent permitted by law, NovaKey Realty and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, goodwill, data, or opportunities, arising from your use of the Services or inability to use them, even if advised of the possibility of such damages.
Our total aggregate liability for any claim relating to the Services will not exceed the greater of (a) one hundred U.S. dollars (US$100) or (b) the amounts you paid NovaKey Realty specifically for digital or marketing Services giving rise to the claim during the six (6) months before you first asserted the claim. (Brokerage mandates may be governed by separate agreements; where those agreements set different liability rules, those terms control for those services.)
12. Indemnity
You will defend, indemnify, and hold harmless NovaKey Realty and its affiliates from claims, losses, liabilities, and expenses (including reasonable attorney fees) arising out of your violation of these Terms, your misuse of the Services, your content you submit, or your infringement of third-party rights.
13. Changes to these Terms
We may update these Terms from time to time; the revised version will be posted with an updated effective date. Continued use after the effective date constitutes acceptance unless applicable law requires additional steps.
14. Governing law and disputes
These Terms are governed by the laws of the United States and the State in which NovaKey Realty maintains its principal business presence, without regard to conflict-of-law principles that would send disputes elsewhere. Subject to mandatory consumer protections where you reside, courts in that State have jurisdiction unless a separate written agreement provides for arbitration or a different venue.
